Sparkling Design and Infotech (P) Ltd ("we", "us", "our") is a company registered in India at 215, Technopark Trivandrum, Nila Building, Technopark Campus, Thiruvananthapuram, Kerala 695581, India. We operate the UpscaleAI mobile application ("App").

By downloading, installing, or using UpscaleAI, you expressly consent to this Privacy Policy and to the collection, use, and processing of your information as described herein. If you do not consent, please do not use the App.

Specifically, you consent to:

  • Collection of anonymous usage analytics to improve the App
  • Crash and performance reporting via Firebase Crashlytics
  • Anonymous Firebase Authentication to provide the service
  • Processing of images you submit, solely for the purpose of AI upscaling
  • Display of advertisements (non-premium users only), subject to your ATT preference
  • Push notifications, subject to your device permission

You may withdraw consent at any time as described in Section 9 of this Policy.


3.1 Images You Submit

When you submit an image for upscaling, we want to be fully transparent:

  • Your image is transmitted securely to our processing servers
  • It is processed by our AI model to generate the enhanced version
  • The original and upscaled images are deleted from our servers within 24 hours
  • We do not use your images to train AI models
  • We do not share your images with any third parties
  • We do not store, index, or analyse your images beyond what is required to perform the upscale

When you purchase a Monthly Subscription, Apple processes your payment. We receive from Apple:

We do not receive, process, or store payment card details or billing addresses. For legacy Lifetime Access users, we retain your purchase receipt to verify continued premium status.

3.4 Information from Third-Party Services


We do not use your information for automated decision-making or profiling that produces legal or significant effects on you.


If you are in the EEA or UK, we rely on the following legal bases:

  • Consent: Image processing, push notifications, advertising personalisation (IDFA) — withdrawable at any time
  • Contract Performance: Processing to deliver the subscription service you purchased
  • Legitimate Interests: Anonymous analytics, crash reporting, fraud prevention, service improvement
  • Legal Obligation: Compliance with applicable law

We do not sell, rent, or trade your personal data. We share data only with:

Each provider acts as a data processor bound by contractual obligations and their own privacy policies.

7.2 Business Transfers

In the event of a merger, acquisition, or asset sale, your data may be transferred. We will notify you of any such change.

7.3 Legal Requirements

We may disclose your data when required by law, court order, or to protect our rights or user safety.


Our service providers operate globally, including in the United States. When transferring data from the EEA, we rely on Standard Contractual Clauses approved by the European Commission to ensure appropriate safeguards.

UpscaleAI is not directed at children under 13 (or 16 in certain EEA jurisdictions). We do not knowingly collect data from children. If you believe your child has provided us with information, contact us immediately at support@sparklingapps.com and we will delete it promptly.


We implement the following security measures:

  • Encrypted image transmission using HTTPS/TLS
  • Automatic deletion of processed images within 24 hours
  • Access controls limiting who can access user data
  • Regular security reviews

No method of transmission over the internet is 100% secure. We cannot guarantee absolute security. In the event of a data breach posing risk to your rights, we will notify the relevant authority within 72 hours and affected users without undue delay.


Non-premium users see ads served by Google AdMob. When you first launch the App, iOS presents Apple's ATT prompt:

  • Allow tracking: Personalised ads based on your interests may be shown
  • Deny tracking: Non-personalised, contextual ads are shown instead

Change your preference anytime in Settings › Privacy & Security › Tracking. Premium subscribers and legacy lifetime access holders do not see any advertisements.


iOS will request your permission before we send push notifications. Manage or revoke permission anytime in Settings › Notifications › UpscaleAI.


California residents have the following rights:

Categories collected in past 12 months: Device identifiers, usage data, approximate geolocation (country level), subscription confirmation data, IDFA (with consent only).

This Privacy Policy is published in compliance with the Information Technology Act, 2000 and the IT (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011. We have implemented reasonable security practices as required under Indian law.


We may update this Policy from time to time. We will notify you of material changes by updating the "Last Updated" date and providing in-App notice. Continued use after changes constitutes acceptance.
